Terms of Service

1. Eligibility & Account Registration

• You must be at least 18 years old to use mirabook.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and up-to-date information.
• You are responsible for all activity that occurs under your account.

2. Use of the Services

You agree to use mirabook only for lawful business purposes.

You must not:

• Use the Services for illegal, fraudulent, or abusive activities
• Attempt to access or interfere with systems without authorization
• Reverse engineer, copy, or resell the Services
• Introduce malware, bots, or automated abuse
• Violate applicable laws or third-party rights

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Plans & Billing

• Some features require a paid subscription.
• Pricing, features, and billing cycles are described on our website.
• Subscriptions renew automatically unless cancelled before the end of the current billing period.
• We may change pricing with reasonable prior notice. Existing subscribers will be notified before any price changes take effect on their next renewal.

All payments are processed by a third party ("Payment Processor"), who acts as our Merchant of Record. This 3rd-party handles all billing, invoicing, payment processing, sales tax, and VAT on our behalf. When you make a purchase, your transaction is with this 3rd-party, and their terms and policies apply to the payment process. You may receive invoices and payment-related communications directly from them.

4. Refunds & Cancellations

We want you to be satisfied with mirabook. If you are not happy with your purchase, the following refund policy applies:

Refund Eligibility

• You may request a full refund within 14 days of your initial subscription purchase, provided you have not extensively used the Services during that period.
• Refund requests made after the 14-day window will be assessed on a case-by-case basis at our sole discretion.
• Renewal charges (monthly or annual) are not eligible for a refund once the new billing period has begun, unless required by applicable law.

How to Request a Refund

• Contact us at info+legal@mirabook.app with your account email and reason for the refund request.
• Since we use a 3rd-party as our Merchant of Record, refunds will be processed by them. Approved refunds will be returned to your original payment method.
• Please allow up to 10 business days for the refund to appear on your statement, depending on your payment provider.

Cancellations

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, you will retain access to paid features until the end of your current billing period.
• No further charges will be made after cancellation takes effect.
• Cancelling your subscription does not automatically entitle you to a refund for the current billing period.

Exceptions

We reserve the right to deny refund requests where there is evidence of abuse, fraud, or violation of these Terms. Refund rights required by applicable consumer protection laws (including EU/EEA statutory withdrawal rights) are not affected by this policy.

5. Free Trials & Beta Features

• Free trials may be offered at our discretion.
• We may modify or discontinue trials at any time.
• Beta or early-access features are provided "as is" and may contain bugs.

6. Customer Data & Ownership

• You retain ownership of all data you submit to mirabook.
• You grant us a limited license to process your data solely to provide the Services.
• You are responsible for the accuracy and legality of your data.
• mirabook does not claim ownership of your customer data.

7. Data Protection & Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

You agree to comply with applicable data protection laws for any customer data you process using mirabook.

8. Availability & Service Changes

• We aim to provide a reliable service but do not guarantee uninterrupted availability.
• Maintenance, updates, or outages may occur.
• We may modify, improve, or discontinue features at any time.

9. Third-Party Services

• mirabook integrates with reCAPTCHA. Therefore, Google's Privacy Policy and Terms apply.
• mirabook may integrate with or link to additional third-party services.
• Your use of third-party services is subject to their own terms.

10. Intellectual Property

• mirabook and all related content, branding, and software are owned by us.
• You are granted a limited, non-exclusive, non-transferable license to use the Services.
• You may not use our branding without written permission.

11. Termination

You may cancel your account at any time.

We may suspend or terminate your account if:

• You breach these Terms
• Required by law
• Your use poses a security or legal risk

Upon termination, your access to the Services will cease.

12. Disclaimers

The Services are provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, including:

• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of data

13. Limitation of Liability

To the maximum extent permitted by law:

• mirabook is not liable for indirect, incidental, or consequential damages
• Our total liability will not exceed the amount paid by you in the 12 months prior to the claim

14. Indemnification

You agree to indemnify and hold harmless mirabook from claims arising from:

• Your misuse of the Services
• Your data or content
• Your violation of these Terms or applicable laws

15. Governing Law

These Terms are governed by the laws of the Democratic Republic of Sri Lanka ("Sri Lanka"), without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Services after changes means you accept the updated Terms.
